Terms and Conditions
The following general terms and conditions apply to all our services.
- Law Firm Petkovski is located in Apeldoorn. The firm aims to provide legal assistance in legal proceedings, representing the client before all judicial bodies, and to provide legal advice.
- These general terms and conditions apply to all assignments, including any supplementary assignments and follow-up assignments carried out by Law Firm Petkovski.
- Law Firm Petkovski is the sole contractor for all work. The work is performed solely under the responsibility of Law Firm Petkovski and for the benefit of the client.
- Law Firm Petkovski is entitled to engage third parties on behalf of the client in the performance of an assignment. If third parties must be engaged in connection with the work assigned to Law Firm Petkovski, Law Firm Petkovski will, if and to the extent possible, consult with the client in advance and will exercise due care in selecting these third-party contractors. Petkovski Law Firm is not liable for any errors or shortcomings of such a third party in the performance of its services. Petkovski Law Firm reserves the right to accept on behalf of the client any limitation of liability that such a third party may have stipulated.
- Any liability of Law Firm Petkovski for work performed or to be performed by or on behalf of Law Firm Petkovski, or otherwise related to an assignment given to Law Firm Petkovski, is limited to the amount claimable in the relevant case under the professional liability insurance(s) taken out by Law Firm Petkovski, plus the deductible payable by Law Firm Petkovski in the relevant case under the terms of that insurance(s).
- If the attorney is assisting two or more persons and a conflict of interest arises between these persons, the attorney must withdraw and may no longer assist any of the parties, unless this is expressly agreed upon by all parties. In such cases, the attorney will not automatically cease work at the request of one of the parties if deadlines must be observed.
- For the execution of the assignment, the client owes Petkovski Law Firm a fee of at least €250 per hour, excluding 21% VAT. In some cases, the hourly rate may be adjusted upwards or downwards, depending on the nature of the case or its urgency.
- If legal aid has been granted, the client is liable for the client's contribution. In addition, any disbursements are the client's responsibility. Disbursements include costs such as court fees, requests for medical information, extracts, expert fees, and any third-party fees. All amounts due are increased by the applicable VAT rate. Law Firm Petkovski does not charge office costs.
- In other cases, a fixed fee is charged. This amount is based on the standard hourly rate of €250, excluding 21% VAT. In cases where a case will be terminated prematurely, this hourly rate will apply, except for the first three hours. Refund of the first three hours is not possible in the event of premature termination, regardless of the nature and duration of the actual work, as this includes administrative tasks in addition to all regular work and that is also the standard advice fee. If no substantive (inhoudelijk) work has been done the amount will be returned minus one hour.
- Regarding fees, Law Firm Petkovski invoices the entire fixed amount in advance. If the full amount due has not been paid, work will not commence unless expressly agreed otherwise or unless a legal aid grant with a personal contribution (eigen bijdrage bij toevoeging) has been awarded.
- The firm does not offer a free initial consultation or introductory meeting, except in cases in which legal aid has been granted for that specific case. There is also no consultation fee. The minimum fee is the advice fee.
- Law Firm Petkovski does not have a Stichting Derdengelden and cannot hold any funds on behalf of the client.
- After the end of the assignment, the original documents in the file will be provided to the client upon request. After closing and archiving the file, Law Firm Petkovski will retain the created file for a statutory period of 5 years. After this period, the files will be destroyed. Copies of the file are free of charge, as only digital files are used.
- The firm maintains a complaints procedure that applies to its services. The complaints procedure can be found on the website or sent upon request.
- Mr. E. Tas of Deventer will act as deputy for the firm in the event of absence due to illness, vacation, or special circumstances. The client accepts that, if necessary, this colleague will be able to act in legal proceedings or will engage a colleague specializing in immigration law or asylum law. The practice agreement signed with him on April 11, 2011, applies. This agreement can be inspected at the office upon request.
- The legal relationship between Law Firm Petkovski and the client or any third party is governed by and subject to Dutch law.
- All disputes must be submitted to the Dutch courts.
